{"id":1056,"date":"2021-12-06T07:00:56","date_gmt":"2021-12-06T07:00:56","guid":{"rendered":"https:\/\/apptechllc.com\/?p=1056"},"modified":"2024-09-23T12:56:15","modified_gmt":"2024-09-23T12:56:15","slug":"the-paid-act-deadline-is-here","status":"publish","type":"post","link":"https:\/\/apptechllc.com\/the-paid-act-deadline-is-here\/","title":{"rendered":"The PAID Act Deadline is Here"},"content":{"rendered":"<p>Last June, we published a post called, <a href=\"https:\/\/apptechllc.com\/clean-up-your-paid-act\/\" target=\"_blank\" rel=\"noopener\">Clean Up Your PAID Act<\/a>. It laid out the reasons that entities\u00a0required to comply with the Medicare, Medicaid, and SCHIP Extension Act (MMSEA) of the Centers for Medicare and Medicaid Services (CMS) and its Section 111 reporting requirements would soon be facing new mandates. Those mandates would be coming under the new compliance guidelines of the Provide Accurate Information Directly (PAID) Act. The PAID act was signed into law on December 11, 2020.\u00a0<span id=\"more-620\"><\/span>As promised by CMS, <a href=\"https:\/\/www.cms.gov\/Medicare\/Coordination-of-Benefits-and-Recovery\/Mandatory-Insurer-Reporting-For-Non-Group-Health-Plans\/Whats-New\/Whats-New\" target=\"_blank\" rel=\"noopener\">the new law goes into effect on December 11, 2021<\/a>. That\u2019s Saturday of this week.<\/p>\n<p>The PAID Act enable insurers to better identify claimants\u2019 Medicare plans and to avoid unnecessary litigation. And it prevents the lawsuits that were being filed by Medicare Advantage Plans against insurers for double recovery and for failure to provide primary payment or reimbursement for qualifying charges. But it will require all\u00a0responsible reporting entities (RREs) to manage additional data from CMS \u2014 data they they weren\u2019t required to manage before the PAID Act. More specifically, the PAID Act requires CMS to deliver Medicare Part C (Medicare Advantage Plans) &amp; Part D information to help RREs resolve liens with Medicare. That, however, requires significant changes to Section 111 reporting systems.<\/p>\n<p>That means, beyond your present system\u2019s inability to access the new fields, without changes, many systems won\u2019t be able to process the new CMS query responses at all. That may render your current Section 111 reporting process obsolete. And it will put your CMS compliance at very real risk.<\/p>\n<p>Depending on when your CMS reports are due, you don\u2019t have much time.
